Public Offer

This document constitutes a Purchase Agreement between the E-commerce Agent, hereinafter referred to as the “Agent”, and the Buyer, and defines the terms and conditions for the purchase of goods through the website shopshop.md, hereinafter referred to as the “Website”.

1. GENERAL PROVISIONS

This document represents a public offer in accordance with Article 681 of the Civil Code of the Republic of Moldova and Law No. 284 "On Electronic Commerce".

After viewing the goods on the website, the Buyer may purchase the desired item. In doing so, the Buyer familiarizes themselves with this offer and accepts it by checking the box “I have read and agree to the terms of the public offer”. By doing so, the Buyer concludes an electronic agreement for the purchase of goods or services.

The Agent has the right to withdraw the offer before confirming its acceptance to the Buyer. The Agent undertakes to confirm the acceptance or withdraw the offer within 24 hours of receiving the Buyer’s acceptance. Withdrawal of the offer is carried out by sending an electronic notification to the Buyer indicating the reason for the withdrawal.

In the event that the Agent informs the Buyer of the impossibility to deliver the full range of ordered goods, the Buyer undertakes to confirm or decline the revised order within 24 hours.

The Buyer has the right to withdraw the acceptance of the offer if the notice of withdrawal is received before the Agent’s confirmation.

The Agent undertakes to deliver the goods to the Buyer under the terms of this Agreement and to receive payment, while the Buyer undertakes to pay for and accept the goods under the same terms.

2. INFORMATION ABOUT THE GOODS

The goods, which are the property of the Agent, are presented in the catalog via sample photos and/or descriptions, which contain textual information, specifications, parameters, price, and characteristics (with a link to the product details).

The price of the goods is specified in the product description. Delivery costs are calculated depending on the delivery location and volume of the goods (see the “Payment and Delivery” section: https://shopshop.md/dostavka-schastiya/). The delivery price is shown during the checkout process.

The physical location of the goods is defined as:

1. at the Agent’s address
2. at the address of the postal service provider

3. DELIVERY AND ACCEPTANCE OF GOODS

The Parties agree that the goods shall be delivered to the Buyer through the services organized by the Agent, and paid for by the Buyer.

The Buyer pays for delivery using one of the methods offered by the Agent during the checkout and delivery selection process.

The Agent delivers the goods to the Buyer after the Buyer has accepted this Agreement and agreed to the payment terms.

The Buyer agrees to accept the goods within the indicated delivery timeframe.

The act of acceptance is confirmed by the Buyer signing the delivery receipt.

If the Buyer refuses to accept the ordered goods or any part thereof, the Buyer agrees to cover the delivery costs incurred by the Agent.

The Agent undertakes to deliver only the goods that were ordered by the Buyer when concluding this Agreement. The Agent bears full responsibility in case of failure to comply with this condition, including covering the delivery and return costs.

The Agent guarantees that all information about the goods presented in this Agreement is accurate.

The Agent guarantees that the goods will be packaged appropriately to prevent damage during delivery.

The Buyer is obliged to accept the goods without objection if the packaging is intact.

4. PAYMENT METHOD

The Buyer may choose a convenient payment method from the following options:

1. payment by bank card transfer to the Agent's account;
2. cash payment upon receipt of the goods.

5. MISCELLANEOUS

Ownership of the goods passes to the Buyer upon receipt.

The Agent bears full responsibility to the Buyer for the conformity of the goods and for accepting returns and providing replacements in the event of non-conformity, in accordance with the Law “On Consumer Protection”.

The Agent guarantees compliance with all provisions of the Law “On Consumer Protection” in the fulfillment of its obligations under this Agreement.

This Agreement is drafted in the Russian language.

Any amendments or additions to this Agreement shall be made electronically and form an integral part of the Agreement.

This Agreement enters into force upon acceptance and remains in effect until the Parties fulfill their obligations in accordance with its terms.

This Agreement may be terminated if:

1. The Agent fails to deliver the goods within the timeframe specified in the Agreement;
2. The Buyer fails to accept the goods within the specified timeframe;
3. The Agent delivers goods that do not comply with the terms of this Agreement.
